The U.S. Supreme Court has denied a petition by antinuclear group Beyond Nuclear challenging the Nuclear Regulatory Commission’s licensing of Holtec International’s proposed consolidated interim storage facility (CISF) for spent nuclear fuel in New Mexico.

The denial of Beyond Nuclear’s writ of certiorari petition was part of a long list of orders released by the Supreme Court on Monday. The list also included a denial of Duke Energy’s appeal of a lower court’s ruling in an antimonopoly dispute.

The U.S. Supreme Court may once again scrutinize the Nuclear Regulatory Commission’s authority to license consolidated interim storage facilities for commercial spent nuclear fuel. The antinuclear group Beyond Nuclear has filed a petition with the court for a writ of certiorari review of an August 2024 appeals court decision rejecting the group’s lawsuit against the licensing of Holtec International’s New Mexico storage facility, the HI-STORE CISF.

The Nuclear Regulatory Commission is hosting a hybrid public meeting with Holtec next week to discuss plans for needed repairs at Michigan’s Palisades nuclear plant before bringing the unit back on line.

A federal appeals court rejected a lawsuit brought by environmental groups challenging the Nuclear Regulatory Commission’s licensing of a consolidated interim storage facility (CISF) for spent nuclear fuel in Andrews County, Texas. The U.S. Court of Appeals for the D.C. Circuit found that the NRC reasonably applied its hearing regulations when approving Interim Storage Partners’ (ISP) license for the facility.

The antinuclear organization Beyond Nuclear is appealing the Nuclear Regulatory Commission’s dismissal of its petition to intervene in the proceeding for Interim Storage Partners’ (ISP) application to build and operate a consolidated interim storage facility (CISF) for spent nuclear fuel in western Texas. Beyond Nuclear filed suit in the U.S. Court of Appeals for the District of Columbia Circuit on February 10, asking the court to order the dismissal of the license application.

ISP, a joint venture of Waste Control Specialists (WCS) and Orano, submitted its application for the CISF with the NRC in June 2018. In September 2018, Beyond Nuclear filed a motion to dismiss the application. An NRC Atomic Safety and Licensing Board denied Beyond Nuclear’s request for a hearing in the licensing proceedings, and in December 2020, the NRC issued an order upholding that decision.

A Nuclear Regulatory Commission Atomic Safety and Licensing Board will conduct an “oral argument” via WebEx early next month regarding a petition to hold a hearing on North Anna’s subsequent license renewal (SLR) application, the agency announced yesterday.

ASLBs conduct adjudicatory hearings on major licensing actions by the NRC. Their rulings may be appealed to the commission.

The SLR application, submitted by Dominion Energy last August, was docketed by the NRC in October. The petition objecting to it was filed in December by three antinuclear organizations—Beyond Nuclear, Sierra Club, and Alliance for Progressive Virginia.

On February 4, beginning at 2 p.m. Eastern time, the ASLB will address a rule waiver request from the groups, as well as the admissibility of their proposed contention. The board will entertain comments from representatives for the petitioners, Dominion, and NRC staff.

The Nuclear Regulatory Commission has announced the establishment of an Atomic Safety and Licensing Board to address a hearing request filed last month concerning Dominion Energy’s subsequent license renewal (SLR) application for the two reactors at its North Anna plant. The application, submitted in August of last year, was docketed by the NRC in October.

The contention: Filed by three anti-nuclear groups—Beyond Nuclear, the Sierra Club, and the Alliance for a Progressive Virginia—the 71-page hearing request argues that Dominion’s environmental report, submitted in support of its application, “fails to satisfy” the National Environmental Policy Act, as well as 10 CFR 51.53(c)(2) and 51.45(a), “because [the report] does not address the environmental impacts of operating North Anna Units 1 and 2 during the extended SLR term under the significant risk of an earthquake that exceeds the design basis for the reactors.”

The antinuclear organization Beyond Nuclear has filed an appeal with the U.S. Court of Appeals for the District of Columbia Circuit requesting a review of the Nuclear Regulatory Commission’s decision to deny its petition against Holtec International’s application to build and operate a consolidated interim storage facility (CISF) for spent nuclear fuel in southeastern New Mexico.

The Nuclear Regulatory Commission on May 18 sent a letter to Vice President Mike Pence in response to a coalition of critics who had written to the vice president in April, taking issue with the agency’s COVID-19–related actions.
